Does the National Road Traffic Act stipulate the amounts for traffic fines?

Question:

I was recently posted a ticket informing me that I had been trapped by camera on the N1 out side Richmond Northern Cape,allegedly travelling at a speed of not less than 101 kmph.in an 80 kmph. zone.The fine is R900.00. Is this in accordance with the Road Traffic Act? The ticket did not have a picture attached.

Answer:

The National Road Traffic Act does not set down penalty amounts for fines as it does not administer itself. In the case of the jurisdiction where you were caught, the Magistrates Court will have set the fine amount. In the two areas where AARTO is in operation the fine for the infringement would have been R750, which is slightly less than has been set by that Magistrate.

Only when AARTO is rolled out nationwide will the quantum of the penalties be prescribed by a nationwide schedule. Until then, it remains the decision of the Magistrate for the area in which it is incurred.
