Are this guidelines only a recommendation to be followed by traffic departments or have they a legal backing? i.e. Would a violation of these guidelines hold up in court as an argument against a speeding fine?
Answer:
It is just a guideline . Prosecutors would evaluate if a deviation from the guidelines is substantial enough to warrant a withdrawal of a case but it does not form part of the evidence in a case as much of it is just good practice requirements.
