Where can I search for outstanding speed fines against my vehicle and my ID number?

Although there are several websites which are run by the various contractors involved in speed trapping, there is no single website where this can be done and since there are more than 200 municipalities in South Africa this is a bit of a nightmare.

Can the authorities withheld my vehicle license if I have outstanding speed fines?

Not for outstanding speed fines but that there are two instances where they may withhold your licence disc. The one is where a warrant for your arrest has been issued in terms of the Criminal Procedure Act and the other is where an enforcement order has been issued in terms of the AARTO Act. Both are, in my view unconstitutional.

Can I be arrested at a roadblock if I have outstanding fines that I have no knowledge off?

No. You may, however, be arrested if a warrant for your arrest has been issued – but the peace officer is obliged to show you proof of the said warrant if he or she wishes to arrest you on the strength of a warrant of arrest.

If the authorities can’t supply me with details on a camera infringement, is the fine still valid or can it be contested in court?

All traffic fines can be contested in court, regardless of what they are for. In terms of the Criminal Procedure Act, any traffic fine issued is automatically a matter for a court to adjudicate. Under the AARTO Act, you are required to elect to be tried in court. Either way, the onus is on the State to prove your guilt  – not for you to prove your innocence.
