Question: Hi I would like to know who i claim compensation from in SA, when an unknown pedestrian throws a brick at a passenger on a South African road, and has a traumatic brain injury.
Has no money for expensive lawyers.
Needs money to live, but may not be able to work. SANRAL told me I cannot sue them as they are not responsible for safety on their roads.
RAF told me to sue the brick thrower who is probably homeless, and was not caught. Thank you.
It happened on the N12 Highway JHB by Klipriver on ramp I have a SAPS case number.
Answer: In all the counties of the world one has a claim against the person who cause the injury or the damage. In our country one has a claim against the RAF or several other entities because of certain legislation in place.
Unfortunately your injury or loss does not fall into any one of the categories of cover and your only recourse is against the person who caused the injury or damage.
