How will a company ensure that the driver and not the boss incurs demerit points for violations?

Question:

Could you please explain to me how we must do as a company for the demerit points not to go to my boss but to the driver of the vehicle? We have a company car, and sometime our driver, security guard, myself… are using the vehicle. Once the demerit point system is in place – When will it be in place? – how can we make sure that my boss is not going to have all the demerit points for other drivers on the company vehicle? Please help me.

Answer:

Your company have an option of nominating a driver as prescribed in the AARTO Act. Your proxy(transport officer) will have to complete an AARTO 07 form obtainable on our website and send it back to us or call our call centre to help you understand and complete the form correctly. The call centre number is 086 122 7861. When you are nominating a driver that has incurred a traffic fine/ infringement you will need to provide us with the following information(This is the driver who has committed this infringement ):

  •     Full names
  •     Residential address
  •     Postal address
  •     Telephone numbers
  •     Copy of the driver’s acceptable identification e.g. I.D. document

The RTIA shall acknowledge receipt of the nomination of the driver on form – AARTO 05b, within a period of 14 days from receiving such nomination.

If your nomination is accepted, your Infringement Notice will be cancelled , and a second Infringement Notice will be sent (per registered mail) to the driver you have nominated.
