Question:
Please advise me whether the driver of this vehicle (Kia- 2.7 workhorse) is required to wear a seat belt whilst driving.
Regulation 216 in the Act is not as specific regarding the category of vehicle required to be fitted with seat belts.
Your assistance will be greatly appreciated.
Answer:
If there is a seatbelt fitted he must wear it. Reg 213. However the seatbelt specification does not require trucks with a GVM of more than 3 500 kg to be fitted with seat belts.
So if there is no seat belt in the vehicle it is still roadworthy.
